The privacy of your personal data is important to Gene42. This notice (the “Policy”) describes Gene42’s privacy policy as it pertains to the website located at phenotips.com (the “Website”).

  1. Information We Collect. Gene42 may ask for and collect from you personally identifiable and other information at certain points throughout the Website. Depending on the information and/or services you request, you may be asked to provide your name, email address and other information. In addition to the information you knowingly provide, Gene42 collects the domain names and IP addresses of its visitors, along with usage statistics (e.g., types of web browsers and operating systems used) and browsing history. This data is used to more efficiently operate Gene42’s business, promote our services and administer the Websites. Gene42 may combine this information with the personally identifiable and other information it collects. Gene42 also collects any information you may choose to provide in your communications with us. Please do not send us any confidential information. Gene42 does not collect personally identifiable information about your online activities over time and across third party websites or online services.
  2. 16 or Under. We are concerned to protect the privacy of children aged 16 or under. If you are aged 16 or under‚ please get your parent/guardian’s permission beforehand whenever you provide us with personal information.
  3. Lawful Basis. Gene42’s use of personal data is lawful and complies with the Data Protection Act (2018)/UK GDPR to satisfy the common law duty of confidentiality. Our legal bases for acquiring any personal data are (i) ‘Legitimate Interest’,  as defined by Art 6, section 1(f) EU GDPR and ‘Legitimate Interest’ as defined by Art 9, section 2(d) EU GDPR and (ii) consent.
  4. How Gene42 Uses Your Information. Gene42 may use your information (i) to provide you with personalized content; (ii) to process and respond to inquiries; (iii) for the purposes for which you provided the information; (iv) to improve the content and navigability of the Websites; (v) to alert you to new features, special events, and service offerings; and (vi) to enforce the Policy.

  6. Information Sharing with Third Parties. Gene42 may disclose your personally identifiable information to another entity:

    (i) for purposes of outsourcing one or more of the functions described in the previous section; 

    (ii) to confirm or update information provided by you; 

    (iii) to inform you of events, information about our services, and other important information, or 

    (iv) for other purposes disclosed at or before the time the information is collected. If you tell us you wish to attend an event, your name and organization may appear on a list which we provide to other delegates at the event. 

    We may also share your information when legally required to do so. Categories of third parties are cloud hosting providers, analytics tools and CRMs.

  7. Analytics and Marketing Automation (HubSpot)We use HubSpot, Inc. (“HubSpot”), a US-based customer platform, to operate parts of our website, capture form submissions, measure site usage, and manage our customer relationships and marketing communications. HubSpot acts as our data processor (under GDPR and UK GDPR) and as our service provider (under the CCPA/CPRA).
    When you visit our site, HubSpot’s tracking code sets cookies in your browser (including __hstc, hubspotutk, __hssc, and __hssrc) and collects information such as your IP address, browser type, device identifiers, pages viewed, referring URL, time spent on pages, and the actions you take. If you submit a form, this browsing activity is associated with the contact information you provide so we can respond to your inquiry, qualify potential customers, and tailor follow-up communications. The __hstc and hubspotutk cookies persist for up to 13 months; session cookies expire at the end of your browsing session or after 30 minutes of inactivity.
    Our legal basis for this processing is your consent (for visitors in the EEA, UK, and other consent-based jurisdictions), captured through the cookie consent banner displayed on first visit. For visitors in Canada, we rely on your meaningful consent under PIPEDA. For visitors in California, HubSpot processes this data on our behalf under a service provider agreement and does not “sell” your personal information as that term is defined under the CCPA/CPRA.
    Data collected through HubSpot is transferred to and stored in the United States. We rely on the EU-US Data Privacy Framework and the Standard Contractual Clauses approved by the European Commission and the UK Information Commissioner’s Office as the legal mechanisms for these transfers.

    You can withdraw your consent at any time by clicking the “Cookie Preferences” link in our website footer, which will stop HubSpot from setting these cookies and signal Google Consent Mode v2 accordingly. You can also delete existing HubSpot cookies through your browser settings.   8. How We Collect Information. In addition to the methods described above, we and our service providers (see categories in Section 5) collect information using cookies, web beacons, pixel tags or similar digital marker technologies. These methods permit us to collect various types of information, including which pages you visit, which of our newsletter articles you clicked on, and how long you viewed a page. We and our service providers use this information to monitor and improve our website and to show you advertisements about Gene42 when you visit other sites.
  9. How We Protect Information. Gene42 attempts to protect against the loss, misuse and alteration of your personal information. Gene42 has implemented reasonable administrative, technical and physical measures to protect your personal information.
  10. How You Can View Or Update Your Personal Information. To ensure that you have as much control over your personally identifiable and other information as possible, you may update your information by contacting us as provided in the “Contacts” section below. We will use reasonable efforts to process any change you make; provided, however, that requests to delete information are subject to Gene42’s internal reporting and retention policies and all applicable legal obligations. Your specific rights over your personal data can be found here. In summary these are:
    1. the right to access personal data held about them (the right of subject access);
    2. the right to be informed about how and why their data is used – and you must give them privacy information;
    3. the rights to have their data rectified, erased or restricted;
    4. the right to object;
    5. the right to portability of their data; and
    6. the right not to be subject to a decision based solely on automated processing.
  11. International Transfers. We are a company based in Canada, but do business internationally. Your data (research only, anonymised data) might be passed on to our offices, which are in countries outside the European Union, including Canada and the US. The Website is hosted on servers in the United States and Canada. Canada has received a finding of “adequacy” under Article 45 of the GDPR. The United States has not sought nor received a finding of “adequacy” from the European Union under Article 45 of the GDPR. Gene42 relies on derogations for specific situations as set forth in Article 49 of the GDPR. In particular, Gene42 collects and transfers to Canada and the United States personal data only: with your consent to fulfill a compelling legitimate interest of Gene42 in a manner that does not outweigh your rights and freedoms. Gene42 endeavors to apply suitable safeguards to protect the privacy and security of your personal data and to use it only consistent with your relationship with Gene42 and the practices described in this Policy.
  12. Changes to This Policy. We recognize that information privacy is an ongoing responsibility, and so we will from time to time update this Policy as we undertake new personal data practices or adopt new privacy policies. Changes to this Policy are effective as of the effective date listed above, and indicates the last time this Policy was revised or materially changed.
  13. Links. The Websites may contain links to third-party websites. Gene42 is not responsible for the privacy practices or the content of such websites.
  14. EU Representative and UK Representative: Gene42 Inc. is a company located outside of the European Union and United Kingdom. In order to comply with Art 27 EU GDPR and Art 27 UK GDPR, we appointed Prighter as a representative and your point of contact in the European Union and the United Kingdom.
